A woman who was misdiagnosed with the HIV/AIDS virus nine years ago was awarded $2.5 million in damages. Her doctor made assumptions based on conjecture, not science. She was never given an HIV/AIDS blood test and suffered through heavy doses of medication to treat a non-existence medical condition. At least the woman gets her life back, though that multi million dollar award wont be as much as she thinks after Uncle Sam takes his share!
While I agree that lawyers tend to create many of the silly malpractice claims clogging the court systems, it really does not seem fair to limit the amount of damages awarded to victims like this one and others with even greater injuries. Doctors do need to be held to a higher standard than the average person; they need to be held to the standard of a prudent physician.
