Homeowner Associations and Sex Offenders

Before I begin, let me acknowledge that my posting has sporadic of late. This is for two reasons. First, I am sick of politics and arguing about politics. Do not become alarmed. This is almost certainly temporary. I just needed a break. Even the famous donnybrook scene in the The Quiet Man included an interlude in mid-set-to for a pint to slake the thirst. Second, I will admit to being extremely lazy and the least diversion will suffice to throw me off of any task for which I have a better offer. Generally, writing posts and arguing with our genteel readers provides just the diversion. However, lately, it has been other things which have diverted me from the task of writing posts (see above).

Having said that, a case has arisen here in Central Indiana that I thought was interesting enough to break out of my political ennui and aversion to writing. It seems that a homeowner’s association has passed a new covenant that would ban persons registered as sex offenders from living in the community. The story is here.

The upshot is that sex offenders are not a protected class and homeowner’s associations are not government entities so there is no constitutional issue here.

I generally don’t like homeowner’s associations and would never live in a community that has one. However, if a person voluntarily agrees with his neighbors to give up some of his property rights, I suppose I have no problem with that. It’s just not something I’m not going to do any time soon. In light of that stance, I suppose I have no choice but to hope that the court finds that homeowners are free to consent to limitations on who may live in their neighborhoods. After all, I don’t have to live there and neither do sex offender registrants.
